Subscription Policy

Effective Date: December 4, 2025

This Subscription Policy ("Policy") outlines the terms and conditions applicable to all subscription services provided by Webrain OU ("we", "us", or "our"), a company registered in Estonia, operating globally through is*hosting (the "Service"). This Policy governs your rights and obligations when subscribing to our premium services. By purchasing a subscription, you agree to be bound by this Policy in addition to our Terms of Use, Privacy Policy, and all the related policies.

1. Overview of Subscription Services

We offer subscription plans that grant you access to certain services and features in our Service. Subscriptions may include, but are not limited to, discounts, exclusive tools or functionalities, and early access to new features. The scope of access is defined on the relevant product or pricing page at the time of subscription.

Current available and upcoming subscriptions include:

  • is*smart: Includes access to specific modules and benefits as described below.

Products included in a subscription may be added or removed over time. We may, at our discretion, introduce new products or discontinue existing products within a subscription tier. Where feasible, we will provide at least 30 days’ notice before a removal takes effect, and you will not be charged extra for any product additions during your current billing cycle.

2. Eligibility and Account Requirements

To be eligible for a subscription:

  • You must be at least 18 years of age or the age of legal majority in your jurisdiction.
  • You must have a registered user account in our Service.
  • You must provide a valid and accepted method of payment.

By subscribing, you confirm that you meet all eligibility criteria.

Please note: To prevent fraud and ensure compliance, customers with a "Restricted Access" and "Verification Recommended" account statuses may be required to complete KYC (Know Your Customer) verification before accessing or renewing subscription services.

3. Subscription Plans and Billing Cycles

3.1. Billing Cycles

Subscriptions are offered on a recurring basis, typically monthly or annually. The specific billing cycle applicable to your subscription will be indicated at checkout and in your account dashboard.

  • is*smart is available in billing cycles of 1, 3, 6, 12, 24, and 36 months.

3.2. Payment Authorization

The User must either make payments manually using any available method or authorize automatic deductions from their internal account balance, provided sufficient funds are available. By activating is*smart subscription, the User gives explicit consent to such automatic balance deductions for future renewals.

3.3. Billing Details

You can explore the relevant pricing on the corresponding product or pricing sections. Invoices will reflect applicable taxes, including VAT as per your location and EU tax regulations. You are responsible for ensuring that all billing information is accurate and up-to-date.

3.4. Delivery of Subscription Services

Provision of the subscription service is fulfilled through continuous access to digital features and benefits throughout the subscription term. The service begins immediately upon activation and is considered delivered progressively over the duration of the selected subscription period (e.g., 1, 3, 6, or 12 months).

3.5. Payment Failure

If automatic renewal is enabled but your balance or payment method has insufficient funds on the renewal date, your subscription will not be renewed. Your access to subscription benefits will cease at the end of the current billing period. You may reactivate your subscription at any time by purchasing a new plan at the then‑current price.

4. Auto-Renewal and Renewal Notifications

All subscriptions are subject to automatic renewal unless explicitly canceled. Before renewal, you will receive an advance notice via email outlining:

  • Invoice number
  • Amount due
  • Invoice link

5. Right of Withdrawal (EU Consumers)

Under Directive 2011/83/EU, if you are an EU consumer, you have the right to withdraw from a subscription within 14 days of purchase without giving any reason.

To exercise this right, send a written notice to support@ishosting.com or create a ticket in your Dashboard with a corresponding request clearly stating your intention to withdraw.

Important: If you gain access to digital content or services (for example, you redeemed a bonus/discount or invoked an AI model) before the withdrawal period ends and expressly agreed to waive your withdrawal right, you will not be eligible for any refund.

For partial‑use scenarios (e.g., a 12‑month plan cancelled in the first month), the same rule applies — if any subscription benefit has been consumed, the withdrawal right is waived.

6. Effect of Cancellation

  • Bonuses & discounts – All unused bonuses, promotional credits, and subscription‑related discounts expire simultaneously with your subscription.
  • AI‑model access – Access to any AI models provided under the subscription ends immediately upon cancellation.
  • Balance‑top‑up bonuses – If you received a balance‑replenishment bonus during an active subscription, that bonus will remain available on your balance.

6.1. Re-Subscription

If your subscription has expired (and was not renewed automatically), you may purchase the same subscription again at the then‑current price. No cooldown period applies, but we reserve the right to introduce anti‑abuse measures (e.g., limiting repeated cancellations/re‑purchases) if fraudulent behavior is detected.

7. Cancellation and Termination by User

You may cancel your subscription at any time by:

  • Logging into your account and managing subscriptions, or
  • Contacting customer support at support@ishosting.com or via tickets in your Dashboard.

Cancellations take effect immediately. Access to premium features will be terminated. No further charges will be applied.

Please note: A subscription such as is*smart may only be one active per account. Multiple subscriptions are not allowed.

8. Refund Provisions

Refunds are handled in compliance with EU law and our general Refund and Cancellation Policy.

8.1. Uniform Treatment of Cancellations

Refund eligibility is determined by this Policy, regardless of whether the cancellation is initiated by you or by us. Unless otherwise required by law, any unused portion of the current billing period is not refunded, except where mandated under the 14‑day withdrawal right described in Section 5.

9. Subscription Features and Benefits

9.1 is*smart (MVP)

Includes the following components:

  • is*ai: Access to a curated set of AI models with limited token usage. Available models include: Gemma3, Qwq, Deepseek-r1, Llamma3.3, and Phi4. The list of supported AI models can change from time to time, so please refer to this Policy or the corresponding product or pricing page to get relevant information.
  • is*partners: Discounts and special offers from our official partners.

General Benefits:

  • 5% discount on all services purchased through the Service while the subscription is active.
  • Early access to newly released features.
  • Exclusive offers from third-party partners.
  • Additional bonuses for balance replenishment, as follows:

Limitations:

  • KYC verification may be required for users with flagged or restricted accounts.
  • Only one active is*smart subscription is permitted per account.

10. Changes to Subscription Terms or Pricing

We reserve the right to modify our subscription terms, features, or pricing at any time. Any changes will apply only after the current billing cycle ends. At the time of purchase, the subscription terms are fixed and apply as-is, with any future changes to the plan affecting only new purchases and not altering existing subscriptions unless explicitly requested by the user.

11. Termination by Us

We may suspend or terminate your subscription if:

  • You violate our Terms of Service or this Policy,
  • We detect unauthorized or fraudulent activity,
  • Your payment method fails after repeated attempts.

If we terminate your subscription for the above reasons, the same refund rules outlined in Section 8 apply.

Where possible, notice and an opportunity to remedy the issue will be provided.

12. Data Protection & AI Usage

Data Processing Location – All prompts sent to our AI models are processed on servers located in the EU / EEA or in jurisdictions offering an adequate level of protection as recognized by the European Commission.

Retention – Prompt data and generated outputs are retained for up to 30 days solely for operational purposes (e.g., abuse monitoring, service improvement) and are then permanently deleted or anonymized.

GDPR Compliance – We act as the data controller for personal data you submit to our Service and comply with GDPR obligations, including data‑subject rights of access, rectification, erasure, and portability.

Post‑Cancellation – After a subscription ends, you will no longer be able to retrieve chat history created with subscription‑only AI models. All such data will follow the retention schedule above and will not be further processed once deleted.

13. Subscription Status & Expiry Information

You can view the exact end‑date of your current subscription at any time:
  • In your Dashboard → is*smart section; and
  • In the renewal reminder emails sent at least 7 days before each renewal.

14. Governing Law and Jurisdiction

This Policy shall be governed by and construed in accordance with the laws of Estonia and relevant EU regulations. Any disputes shall be subject to the exclusive jurisdiction of the Estonian courts, unless otherwise mandated by consumer protection laws in your country of residence.
